An Independent Panel was appointed to review submissions.   It conducted a Panel Hearing on the 30 & 31st October 2017.   The Panel has provided its report to Council and a copy is provided below under "Panel Hearing Documents" or Click here.

Council considered a report on the submissions to Amendment C349 Ocean Grove Significant Tree Project and resolved to refer them to an Independent Panel.


During exhibition of Amendment C349, the State Government changed residential zones across the State, including building height limits.  Council now proposes to rezone Areas 4, 5 and 6 on the above map to a new Neighbourhood Residential Zone Schedule 5, with the same 9 metre maximum building height limit as the exhibited proposed General Residential Zone Schedule 3.  This change is proposed to maintain the building heights originally proposed in the Amendment and to avoid the impacts of higher buildings on the landscape.

The amendment seeks to implement recommendations of the Ocean Grove Significant Tree Project, adopted by Council in September 2016.  The project aims to identify and protect, through planning controls, the unique coastal/bush landscape character within the well established areas of Ocean Grove.

  

Amendment C349 proposals (as originally exhibited and not including changes referred to above regarding Neighbourhood Residential Zone)

 

The amendment proposes to:

  • Rezone areas to a new General Residential Zone Schedule 3 (Ocean Grove Hillside Area) and new Neighbourhood Residential Zone Schedule 4 (Ocean Grove Significant Tree Area).

  • Apply a new Significant Landscape Overlay Schedule 15 (Ocean Grove Significant Tree Residential Area) to that precinct.

  • Revise the controls in Significant Landscape Overlay Schedule 7 (Ocean Grove Hillside Area).

  • Eliminate the overlapping controls of the Significant Landscape Overlay Schedule 7 and the Residential Growth Zone Schedule 3 by:

  •  rezoning some land from Residential Growth Zone 3 to the new General Residential Zone 3; and

  •  for other areas, replacing Significant Landscape Overlay 7 with Design and Development Overlay 14. 

  • Amend Clause 21.14 (Bellarine Peninsula) to include reference to vegetation protection in a strategy for Ocean Grove.

Breakdown of changes by area

The proposal for each area is:

 

Area 1 

  • Rezone the area from General Residential Zone Schedule 2 to a new Neighbourhood Residential Zone Schedule 4.

  • Replace Design and Development Overlay Schedule 14 with a new Significant Landscape Overlay Schedule 15.

 

Area 2 

  • Rezone the area from General Residential Zone Schedule 2 to a new Neighbourhood Residential Zone Schedule 4.

  • Apply a new Significant Landscape Overlay Schedule 15.

 

Area 3 

  • Rezone the area from General Residential Zone Schedule 2 to a new Neighbourhood Residential Zone Schedule 4.

  • Replace Significant Landscape Overlay Schedule 7 with a new Significant Landscape Overlay Schedule 15.

 

Area 4

  • Rezone the area from General Residential Zone Schedule 2 to a new General Residential Zone Schedule 3.

  • Revise the wording of Significant Landscape Overlay Schedule 7.

 

Area 5

  • Rezone the area from General Residential Zone Schedule 2 to a new General Residential Zone Schedule 3. 

Area 6 

  • Rezone the area from Residential Growth Zone Schedule 3 to a new General Residential Zone Schedule 3.

  • Revise the wording of Significant Landscape Overlay Schedule 7. 

Area 7 

  • Replace Significant Landscape Overlay Schedule 7 with Design and Development Overlay Schedule 14. 

Area 8 

  • Revise the wording of Significant Landscape Overlay Schedule 7. 

Area 9 

  • Delete Significant Landscape Overlay Schedule 7. 

Area 10 

  • Rezone the area from General Residential Zone Schedule 2 to Residential Growth Zone Schedule 3.

  • Replace Significant Landscape Overlay Schedule 7 with Design and Development Overlay Schedule 14.

Background to the Ocean Grove Significant Tree Project


Ocean Grove has experienced strong growth over recent years which has seen increased levels of development in established areas.  This development has seen the loss of vegetation and an increase in multi-dwellings and multi-storey housing.

Community consultation associated with various Council projects, such as the 2015 Ocean Grove Structure Plan review, has identified a desire to preserve and enhance the unique coastal landscape character of the township.  Issues raised in the review of the Ocean Grove Structure Plan included the effectiveness of existing vegetation protection controls and the lack of controls in some areas.

Council engaged Okologie Consulting to conduct vegetation surveys and make recommendations on how to best protect and manage the vegetated character in identified areas.  These surveys took place from July to September 2015. 

Council officers prepared a background report which included the vegetation survey findings and analysis of development history, building data and issues with current planning controls.  Draft Policy, Zone and Overlay provisions were prepared with the aim of preserving and enhancing the identified vegetated landscape character.

Public consultation on the project took place in April and May 2016, with 26 submissions received.  As a result of submissions, a number of changes have been made to the proposed planning provisions.

In September 2016, Council adopted the Ocean Grove Significant Tree Project Final Report.  This report can be found under the ‘Supporting Documents’ heading below. 

 

Please note that Significant Landscape Overlay Schedule 15 has now been applied on an interim basis to Areas 1 and 2.
